Terms of Use
These terms are the agreement between you and Naina Consulting, a company registered in France ("we", "fitwake") for use of the fitwake iOS app and this website. Installing or using the app means you accept them. If you do not, do not use the app.
fitwake asks you to exercise immediately after waking. That carries real physical risk, and the app is not a medical device, a trainer, or a source of medical advice. Ask a doctor before using it if you have any heart, joint, blood-pressure, balance, or musculoskeletal condition, if you are pregnant, or if you are recovering from injury or surgery. Stop the mission and use the emergency exit, which is available on every strictness level, if you feel faint, dizzy, or any pain. Clear the space around you before you sleep. You will be moving in a dark room with limited coordination. You exercise at your own risk.
Do not rely on this as your only alarm
fitwake depends on iOS delivering notifications, on the device being charged, awake, unmuted and not in a state that suppresses alarms, and on the camera being able to see you. Any of those can fail. Do not use fitwake as the sole alarm for a flight, an exam, a shift, or anything else where being late has a cost. We are not responsible for a missed wake-up.
Eligibility and your account
You must be at least 13 years old, and old enough in your country to agree to these terms. The app has no accounts and no logins; your data lives on your device, and keeping that device secure is your responsibility.
Subscriptions, renewal and refunds
New subscribers get seven days free. It becomes a paid subscription automatically at the end of those seven days unless you cancel at least 24 hours before they are up. One trial per Apple ID.
All payment is taken by Apple through your App Store account, at confirmation of purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the period ends.
Manage or cancel in your App Store account settings at any time. Deleting the app does not cancel it. Cancelling during the trial keeps your access until the seven days are up.
Handled by Apple under App Store policy. We cannot issue refunds directly.
Whether your subscription is active is confirmed for us by RevenueCat, which needs a connection. Your alarms and missions do not — those run with no network at all.
Prices are shown in the app before purchase and may change for future periods, with notice. If a price rises, the increase applies only after your current period ends.
Beta software
TestFlight builds are pre-release and will contain defects, including ones that stop an alarm from ringing. They are provided for testing only, are not a commercial release, and may be withdrawn or changed without notice. Use them alongside a second alarm.
Licence and acceptable use
You get a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, as set out in Apple's standard End User Licence Agreement, which applies to fitwake in addition to these terms. You may not copy, modify, reverse-engineer, resell, or attempt to defeat the app's mission verification. All software, design, text and marks in the app remain ours.
Apple is not a party to this agreement
These terms are between you and fitwake alone. Apple has no obligation to provide support or maintenance for the app, and is not responsible for any claim relating to it, including product liability, legal compliance, or intellectual property claims. Those are our responsibility. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Warranties and liability
The app is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. To that same extent, we are not liable for indirect or consequential loss, for missed wake-ups, or for injury arising from exercise you chose to perform, and our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer, your statutory rights are unaffected.
Ending it, changes, and governing law
You may stop using the app and delete it at any time. We may suspend access if these terms are breached. If we change these terms materially, the app will tell you before the change takes effect. These terms are governed by French law, and disputes go to the competent French courts, except where mandatory consumer law in your country of residence gives you the right to bring a claim locally. EU consumers may also use the European Commission's online dispute resolution platform. Questions go to fitwake@naina.digital.
